Description of the objective:

Prior to the royal assent of the Northwest Territories Devolution Act, the Northwest Territories Waters Regulations and their enabling legislation, the Northwest Territories Waters Act regulated the use of water and the deposit of waste into waters in the Northwest Territories. As a part of the Northwest Territories Lands and Resources Devolution Agreement, the authority to regulate waters on Commissioner's and private lands were among the responsibilities devolved to the Government of Northwest Territories.

The Northwest Territories Devolution Act repealed the Northwest Territories Waters Act and imported the majority of its provisions into the amended Mackenzie Valley Resource Management Act. This allowed the Minister of Aboriginal Affairs and Northern Development to retain the authority for the management of waters in federal areas and federally managed contaminated sites in the Northwest Territories. At the same time, the Northwest Territories Devolution Act also transferred the Northwest Territories Waters Regulations under the authority of the Mackenzie Valley Resource Management Act, and deemed the regulations to remain in force until they are repealed or replaced.

The proposed amendments will make editorial (non-technical) changes to the Northwest Territories Waters Regulations that will reflect their new legislative authorities, in accordance with the implementation of the Northwest Territories Lands and Resources Devolution Agreement. The proposed amendments will ensure the appropriate geographical scope, as intended by the Northwest Territories Lands and Resources Devolution Agreement, is captured in the Northwest Territories Waters Regulations. The proposed amendments will also ensure all Northwest Territories Waters Regulations provisions accurately reference their corresponding enabling provisions in the amended Mackenzie Valley Resource Management Act.

Public consultation opportunities:

Consultation took place December 9, 2015 to March 7, 2016. Drafts of the proposed amendments to the Northwest Territories Waters Regulations were made available to Aboriginal groups and governments in the Mackenzie Valley, transboundary Aboriginal groups, the Government of the Northwest Territories, co-management boards established under the Mackenzie Valley Resource Management Act, industry and other affected stakeholders for review and comments.
