Pursuant to subsection 13.(2), and subject to subsection 13.(3), of the Canada Petroleum Resources Act, the Minister may issue interests in respect of frontier lands which are restricted by geological formation.  Under the Act, issuance of petroleum interests restricted by geological formation is possible in a number of circumstances, including:

  1. issuance of an exploration licence pursuant to section 22 of the Act.  Exploration licences which may be issued in response to the current 2010-2011 Calls for Bids will not be so restricted.
  2. issuance of a significant discovery licence pursuant to section 30 of the Act in respect of frontier lands included in a declaration of significant discovery by the National Energy Board; and
  3. issuance of a production licence pursuant to section 38 of the Act in respect of frontier lands included in a declaration of commercial discovery by the National Energy Board.

Bidders are also reminded, as per clause 12 of the 2010-2011 Calls for Bids, that the Minister may, pursuant to subsection 33.(1) of  the Canada Petroleum Resources Act, by order subject to section 106, require the interest owner of any interest in relation to any portion of the significant discovery area to drill a well on any portion of the significant discovery area that is subject to that interest, in accordance with such directions as may be set out in the order, and to commence the drilling within one year after the making of the order or within such longer period as the Minister specifies in the order.
